BeskarStaff AI ("we," "our," or "us") is committed to protecting the privacy and security of personal data. This Privacy Policy sets out the principles and practices that govern how we collect, use, store, protect, and disclose personal data when you access or use our website, platform, and related services (collectively, the "Services").

This Privacy Policy applies to all interactions with our Services, including but not limited to:

  • Business users who access our platform for talent search and recruitment purposes; and
  • Individuals whose publicly accessible profile data (for example, information published on professional networking sites such as LinkedIn) is processed, stored, or displayed by our Services.

By accessing or using our Services, you acknowledge that you have read, understood, and, where required under applicable law, consented to the practices described in this Privacy Policy. We advise you to review this policy carefully to understand how your personal data may be processed by us.

This Privacy Policy is designed in accordance with the Swiss Federal Act on Data Protection (revFADP). Depending on your location or specific circumstances, additional regional data protection provisions may apply.

1. Personal Data We Collect

BeskarStaff AI collects and processes only publicly accessible personal data of professionals and potential candidates that they have made available on platforms such as LinkedIn or similar public profiles. The categories of personal data we may collect include:

  • Full name
  • Job title
  • Professional experience and employment history
  • Education history
  • Skills and qualifications
  • Links to public profiles (e.g., LinkedIn URL)
  • Public contact information (if provided by the individual)
  • Profile photos (as displayed publicly on professional platforms)

BeskarStaff AI does not infer, process, or display sensitive personal data (e.g., gender, race/ethnicity, religion, political opinions). Any conclusions drawn regarding such attributes are made solely by the Customer and not generated, processed, or provided by BeskarStaff AI.

In addition, when visiting our website or using our services (e.g., for Business Users):

  • IP address
  • Browser type and version
  • Pages visited and usage patterns
  • Account and company information (for registered users)

We do not process any sensitive personal data as defined under the revDSG/FADP unless such data was made publicly available by the data subject themselves. We do not use automated profiling to evaluate sensitive characteristics.

2. Sources of Personal Information

We collect Personal Information from the following sources:

For candidate profiles in our platform: We collect Personal Information from publicly available sources. This includes publicly visible professional profiles (such as LinkedIn or similar platforms), other public websites, and publicly accessible information provided by companies or organizations. We only store and process information that has been made public by the individuals themselves.

For business users or visitors to our website: We collect Personal Information directly from you. This includes contact details and professional information that you provide when registering, submitting a request, signing up for a demonstration, or otherwise interacting with our platform or team.

Automatically collected information: When you use our website or services, we automatically collect technical information (such as IP address, browser type, access times, and used features) through cookies and similar technologies. This information helps us improve our services and maintain platform security. For more details, please see our Cookie Policy.

Combination of data: We may combine information collected through different parts of our platform where necessary to provide our contractual services.

3. How We Use Personal Information

If you are a Candidate, we use your Personal Information for the following purposes:

To provide recruitment search services: We use Candidate Personal Information from our Talent Database to help connect employers with potential candidates. Specifically, we use Candidate Personal Information to allow our business customers to identify and reach out to candidates who may be suitable for open job opportunities based on the candidates' professional background and publicly available information. Our goal is to help candidates learn about job offers that match their skills and career interests.

If you are a Business User or a visitor to our Sites, we use your Personal Information for the following purposes:

Transactional purposes: We use your contact information, professional and employment details, and other identifiers to provide you with access to the Sites and Services, to set up and manage your user account, to provide our Services, and to communicate with you about your registration, account, or inquiries.

Analytical purposes: We use other identifiers and internet or electronic activity data (such as browsing history and usage patterns) to analyze, research, and better understand how users access and use our Sites and Services. This helps us maintain, support, and improve our Sites and Services and respond to user preferences.

General communication purposes: We may use your contact information to provide updates about our Services or to respond to your direct inquiries. We do not use your data for unsolicited marketing or promotional campaigns unless you have explicitly opted in.

Maintenance and improvement of the Sites and Services: We use your contact information, communication transcripts, and internet activity data to:

  • Provide customer support and handle service requests.
  • Monitor and enhance the functionality, security, and performance of the Sites and Services.
  • Improve your experience by adapting and optimizing our platform to meet user needs.

4. How We Share Personal Information

Service Providers: We share Personal Information with our authorized service providers that perform certain services on our behalf ("Service Providers"). We only provide these Service Providers with the information necessary for them to perform these services on our behalf. Our Business Customers and Business Users: If you are a Candidate, we may share your Personal Information (such as your contact details, professional background, and public profile data) with our business customers and Business Users to support their recruitment efforts. This allows them to contact you regarding potential job opportunities that match your skills and experience.

Advertising Partners: We may allow advertising and analytics partners (e.g., LinkedIn, Facebook) to collect data about your activity on our Sites using cookies or similar technologies. This helps us understand and improve our advertising. For more details, please see our Cookie Policy.

Compliance with Laws and Law Enforcement: We may disclose Personal Information if required by law or if we believe such disclosure is necessary to comply with legal obligations or protect our rights or the rights and safety of others.

Customer Data Input or Uploaded by Business Users: Business Users may provide us with Candidate or employee information, including synced data from third-party systems. We treat this Business Customer Data as confidential and only use it to provide the agreed Services. We do not share Business Customer Data with any third parties.

5. Cookies and Automated Data Collection Technologies

We use cookies and similar technologies to better understand and analyze how visitors interact with our website and services. These technologies help us to continuously improve our platform, provide social media features, and tailor advertising to your interests. Cookies are small files that are stored on your device and allow us to recognize your device upon future visits.

In addition, cookies and comparable technologies help us enhance the security of our website and personalize your user experience. You can adjust your browser or device settings at any time to control whether and how cookies are stored. Please note that disabling cookies may result in certain features or functions of our website not working as intended.

Our website currently does not respond to "Do-Not-Track" signals sent by some browsers that aim to prevent tracking of user behavior.

8. Children's Privacy

Our Sites and Services are intended for individuals who are at least 16 years old. We do not knowingly collect Personal Data from children under the age of 16. If we become aware that we have inadvertently collected Personal Data from a child under 16, we will take steps to delete such information promptly.

9. Processing and Data Transfers

BeskarStaff AI stores and processes Personal Data primarily on servers located in Switzerland or the European Union. Any transfers of Personal Data to other countries will only occur in compliance with the Swiss Federal Act on Data Protection (revFADP), including Articles 16–18, and only where the destination ensures an adequate level of data protection or where appropriate safeguards such as Standard Contractual Clauses are in place. By using our Sites or Services, you acknowledge that your Personal Data may be transferred, stored, and processed outside of your region, subject to the legal protections described above.

10. Managing Your Information Preferences (Business Users)

If you are a Business User, you may review, update, or delete most of your Personal Data used for your account through your account settings. You may also contact us at privacy@beskarstaff.ai to request changes or deletions, or to opt out of certain communications. Please note that while you can opt out of marketing emails, we may still send you administrative messages regarding your account or transactions with us.

11. Candidate Data Privacy Rights

The BeskarStaff AI platform helps our business customers identify potential candidates for job opportunities. We respect your control over your personal data. Upon request, we will confirm whether we hold or process personal data about you. If we have collected your data, we will provide a copy. You may also request correction of inaccurate data, deletion of your data, or that we stop using it. In certain cases (e.g. if required by law, or if deletion is disproportionate in effort), we may not be able to fulfill the request in full but will provide an explanation.

To make a request, please email us at privacy@beskarstaff.ai. We may require verification of your identity (e.g. your name and an email address we have on file). We will retain only the minimum data necessary to ensure continued compliance with your opt-out request, and we will not share this data with employers, recruiters, or other service users.

12. Security and Data Retention

BeskarStaff AI implements physical, electronic, and procedural safeguards to protect personal data, including encryption in transit and at rest where appropriate. Our servers are located in Switzerland and/or the EU, operated by trusted providers such as Infomaniak, and designed to meet Swiss data protection standards.

No system can be guaranteed to be 100% secure. While we strive to protect your data, we cannot guarantee absolute security.

We retain your data only as long as necessary for the purposes set out in this Privacy Policy, including compliance with legal obligations, dispute resolution, or protection of legitimate interests that are not overridden by your rights.

13. Privacy Policy Changes

We may update this Privacy Policy from time to time. If we make material changes, we will notify you through appropriate means (e.g., via email or an in-platform notice). Updates will take effect as of the "Revised" date indicated. Continued use of the Sites or Services means you accept the revised policy.

14. Vulnerability Disclosure Policy

At BeskarStaff AI, the security of our systems and the protection of our users' data are of utmost importance to us. We welcome responsible disclosure of potential vulnerabilities in our systems by security researchers and other external parties.

  • Refrain from exploiting or disclosing the vulnerability publicly or to third parties before we have addressed the issue.
  • Avoid privacy violations, data destruction, or service disruption when conducting your research.
  • Comply with applicable laws at all times.

We greatly appreciate contributions from the security community and are committed to constructive cooperation in addressing potential risks.
