Overview of this Agreement
BeskarStaff GmbH ("we," "our," or "us") is committed to protecting the privacy and security of personal data. This Privacy Policy sets out the principles and practices that govern how we collect, use, store, protect, and disclose personal data when you access or use our website, platform, and related services (collectively, the "Services").
This Privacy Policy applies to all interactions with our Services, including but not limited to:
- Business users who access our platform for talent search and recruitment purposes; and
- Individuals whose publicly accessible profile data (for example, information published on professional networking sites such as LinkedIn) is processed, stored, or displayed by our Services.
By accessing or using our Services, you acknowledge that you have read, understood, and, where required under applicable law, consented to the practices described in this Privacy Policy. We advise you to review this policy carefully to understand how your personal data may be processed by us.
This Privacy Policy is designed in accordance with the Swiss Federal Act on Data Protection (revFADP). Depending on your location or specific circumstances, additional regional data protection provisions may apply.
2. Registration and unauthorized account use
To access the Services, you must register for a BeskarStaff Account by creating a user name, password and providing other information. You agree to provide us with accurate, complete, and current registration information about yourself. It is your responsibility to ensure that your password remains confidential and secure. By registering, you agree that you are fully responsible for all activities that occur under your user name and password. We may assume that any communications we receive under your account have been made by you. If you are a billing owner, an administrator, or if you have confirmed in writing that you have the authority to make decisions on behalf of a customer ("Account Administrator"), you represent and warrant that you are authorized to make decisions on behalf of the Customer and agree that BeskarStaff is entitled to rely on your instructions.
You are responsible for notifying us at support@beskarstaff.com if you become aware of any unauthorized use of or access to your account. You understand and agree that we may require you to provide information that may be used to confirm your identity and help ensure the security of your account. BeskarStaff will not be liable for any loss, damages, liability, expenses or legal fees that you may incur as a result of someone else using your password or account, either with or without your knowledge and/or authorization, and regardless of whether you have or have not advised us of such unauthorized use. You will be liable for losses, damages, liability, expenses and legal fees incurred by BeskarStaff or a third party due to someone else using your account.
1. Personal Data We Collect
BeskarStaff GmbH collects and processes only publicly accessible personal data of professionals and potential candidates that they have made available on platforms such as LinkedIn or similar public profiles. The categories of personal data we may collect include:
- Full name
- Job title
- Professional experience and employment history
- Education history
- Skills and qualifications
- Links to public profiles (e.g., LinkedIn URL)
- Public contact information (if provided by the individual)
- Profile photos (as displayed publicly on professional platforms)
BeskarStaff GmbH does not infer, process, or display sensitive personal data (e.g., gender, race/ethnicity, religion, political opinions). Any conclusions drawn regarding such attributes are made solely by the Customer and not generated, processed, or provided by BeskarStaff.
In addition, when visiting our website or using our services (e.g., for Business Users):
- IP address
- Browser type and version
- Pages visited and usage patterns
- Account and company information (for registered users)
We do not process any sensitive personal data as defined under the revDSG/FADP unless such data was made publicly available by the data subject themselves. We do not use automated profiling to evaluate sensitive characteristics.
3. Representative
You or the person or people creating a BeskarStaff Account ("Representative") individually represent and warrant to BeskarStaff that your Representative is authorised to provide the relevant information described in the account details on your behalf and to bind you to this Agreement. We may require you or your Representative to provide additional information or documentation demonstrating your Representative's authority.
The following special requirements apply in relation to persons that are not at least 18 years old. If you are an individual or sole proprietor, and you are not at least 18 years old, but you are 13 years old or older, your Representative must be your parent or legal guardian. If you are a legal entity that is owned, directly or indirectly, by an individual who is not at least 18 years old, but is 13 years old or older, your Representative must either obtain the consent of your board or of an authorised officer to create a BeskarStaff Account. You may not use the Services if you are under 13 years of age.
2. Sources of Personal Information
We collect Personal Information from the following sources:
For candidate profiles in our platform: We collect Personal Information from publicly available sources. This includes publicly visible professional profiles (such as LinkedIn or similar platforms), other public websites, and publicly accessible information provided by companies or organizations. We only store and process information that has been made public by the individuals themselves.
For business users or visitors to our website: We collect Personal Information directly from you. This includes contact details and professional information that you provide when registering, submitting a request, signing up for a demonstration, or otherwise interacting with our platform or team.
Automatically collected information: When you use our website or services, we automatically collect technical information (such as IP address, browser type, access times, and used features) through cookies and similar technologies. This information helps us improve our services and maintain platform security. For more details, please see our Cookie Policy.
Combination of data: We may combine information collected through different parts of our platform where necessary to provide our contractual services.
4. Verification and risk assessment
At any time during the term of this Agreement and your use of the Services, we may require additional information from you to verify beneficial ownership or control of the business, validate information you provided, verify you or your Representative's identity, and assess the risk associated with your business. This additional information may include business invoices, copies of government-issued identification, business licences, or other information related to your business, its beneficial owners or principals. Your failure to provide this information or material may result in suspension or termination of your BeskarStaff Account.
You authorise us to retrieve information about you from our service providers and other third parties, including credit reporting agencies and information bureaus and you authorise and direct such third parties to compile and provide such information to us. You acknowledge that this may include your name, addresses, credit history, and other data about you or your Representative. You acknowledge that we may use your information to verify any other information you provide to us, and that any information we collect may affect our assessment of your overall risk to our business.
3. How We Use Personal Information
If you are a Candidate, we use your Personal Information for the following purposes:
To provide recruitment search services: We use Candidate Personal Information from our Talent Database to help connect employers with potential candidates. Specifically, we use Candidate Personal Information to allow our business customers to identify and reach out to candidates who may be suitable for open job opportunities based on the candidates' professional background and publicly available information. Our goal is to help candidates learn about job offers that match their skills and career interests.
If you are a Business User or a visitor to our Sites, we use your Personal Information for the following purposes:
Transactional purposes: We use your contact information, professional and employment details, and other identifiers to provide you with access to the Sites and Services, to set up and manage your user account, to provide our Services, and to communicate with you about your registration, account, or inquiries.
Analytical purposes: We use other identifiers and internet or electronic activity data (such as browsing history and usage patterns) to analyze, research, and better understand how users access and use our Sites and Services. This helps us maintain, support, and improve our Sites and Services and respond to user preferences.
General communication purposes: We may use your contact information to provide updates about our Services or to respond to your direct inquiries. We do not use your data for unsolicited marketing or promotional campaigns unless you have explicitly opted in.
Maintenance and improvement of the Sites and Services: We use your contact information, communication transcripts, and internet activity data to:
- Provide customer support and handle service requests.
- Monitor and enhance the functionality, security, and performance of the Sites and Services.
- Improve your experience by adapting and optimizing our platform to meet user needs.
Security and fraud prevention: We use Personal Information to protect our platform, users, and company from fraud, unauthorized access, misuse, or illegal activities.
We will not use your Personal Information for purposes that are materially different, unrelated, or incompatible with the purposes described above without notifying you in advance, in accordance with applicable data protection laws.
5. Disclosures and notices; electronic signature consent
By registering for a BeskarStaff Account, you agree that such registration constitutes your electronic signature, and you consent to electronic provision of all disclosures and notices from BeskarStaff, including those required by law. You also agree that your electronic consent will have the same legal effect as a physical signature. You agree that BeskarStaff can provide notices regarding the Services to you through our website or platform, or by mailing notices to the email or physical addresses identified in your BeskarStaff Account.
You authorise us to provide notices to you via text message to allow us to verify your or your Representative's control over your BeskarStaff Account (such as through two-step verification), and to provide you with other critical information about your BeskarStaff Account and the Services. In the event of a suspected or actual fraud or security threat to your BeskarStaff Account, BeskarStaff will use SMS, email or another secure procedure to contact you.
4. How We Share Personal Information
Service Providers: We share Personal Information with our authorized service providers that perform certain services on our behalf ("Service Providers"). These include providers who help with hosting, data storage, maintenance of our Sites, and marketing support. We only provide these Service Providers with the information necessary for them to perform these services on our behalf. Each Service Provider is required to use reasonable security measures appropriate to the nature of the information, and is prohibited from using Personal Information for any purpose other than as specified by us.
Our Business Customers and Business Users: If you are a Candidate, we may share your Personal Information (such as your contact details, professional background, and public profile data) with our business customers and Business Users to support their recruitment efforts. This allows them to contact you regarding potential job opportunities that match your skills and experience.
Advertising Partners: We may allow advertising and analytics partners (e.g., LinkedIn, Facebook) to collect data about your activity on our Sites using cookies or similar technologies. This helps us understand and improve our advertising. For more details, please see our Cookie Policy.
Compliance with Laws and Law Enforcement: We may disclose Personal Information if required by law or if we believe such disclosure is necessary to comply with legal obligations or protect our rights or the rights and safety of others.
Customer Data Input or Uploaded by Business Users: Business Users may provide us with Candidate or employee information, including synced data from third-party systems. We treat this Business Customer Data as confidential and only use it to provide the agreed Services. We do not share Business Customer Data with any third parties.
6. BeskarStaff's obligations, services and account support
BeskarStaff shall provide the AI-powered candidate search Services and Documentation for the Fees in accordance with the terms of this Agreement.
BeskarStaff represents and warrants to you that for a period of ninety (90) days from your first use of the Services, the Services will function in accordance with this Agreement and the Documentation in all material respects. In the event of a breach of this warranty, BeskarStaff will use its reasonable commercial efforts to remedy the breach or, at BeskarStaff's discretion, may refund the Fees paid for access to the Services.
BeskarStaff has developed and provides access to systems, including application programming interfaces and AI algorithms that may be used to access the Services ("Systems"). You may use the Systems solely as described in the Documentation. You may manage your BeskarStaff Account, search for candidates, and enable additional features through the BeskarStaff dashboard ("Dashboard").
We will provide you with support to resolve general issues relating to your BeskarStaff Account and your use of the Services. This support includes resources and documentation that we make available to you through the current versions of BeskarStaff's support pages, Systems documentation, and other pages on our website (collectively, "Documentation"). 5. Cookies and Automated Data Collection Technologies
We use cookies and similar technologies to better understand and analyze how visitors interact with our website and services. These technologies help us to continuously improve our platform, provide social media features, and tailor advertising to your interests. Cookies are small files that are stored on your device and allow us to recognize your device upon future visits.
In addition, cookies and comparable technologies help us enhance the security of our website and personalize your user experience. You can adjust your browser or device settings at any time to control whether and how cookies are stored. Please note that disabling cookies may result in certain features or functions of our website not working as intended.
Our website currently does not respond to "Do-Not-Track" signals sent by some browsers that aim to prevent tracking of user behavior.
7. Customer's obligations and acceptable use
By accepting using the Services, you represent and warrant that: (i) you are eligible to register and use the Services and have the authority to execute and perform the obligations required by this Agreement; (ii) that any information you provide us about your business, job requirements, or recruitment needs is accurate and complete; and (iii) that your employees, contractors and agents will at all times act consistently with the terms of this Agreement.
You also agree to:
- provide BeskarStaff with all necessary co-operation in relation to this Agreement;
- comply with all applicable laws and regulations with respect to your activities under this Agreement, including Swiss employment and data protection laws;
- ensure that any person who uses the Services and the Documentation under or in relation to your account does so in accordance with the terms and conditions of this Agreement;
- carry out all other Customer responsibilities set out in this Agreement in a timely and efficient manner;
- ensure that your network and systems comply with the relevant specifications provided by BeskarStaff from time to time;
- use all reasonable endeavours to prevent any unauthorised access to, or use of, the Services and/or the Documentation;
6. Be Careful When Sharing Information
If you choose to share personal information or other data in publicly accessible areas of our website, during events, or through other services, please be aware that such information may be viewed, copied, or distributed by others. We have no control over how third parties may use this information. There is a risk that such information could be used outside our platform, including for unsolicited communications or other purposes without your consent.
We therefore recommend exercising caution when deciding what information to share in public areas.
8. Data Usage, Privacy, Security and Confidentiality
8.1 Data Usage Overview
Protecting, securing, and maintaining the candidate information and data processed through our AI-powered recruitment Services is one of our top priorities, and it should be yours too. All data and servers are located in Switzerland, and our team operates from Switzerland to ensure compliance with Swiss data protection laws. This section describes our respective obligations when handling and storing information connected with the Services.
7. Links
Our Sites and Services may contain links to other websites or allow others to send you such links. A link to a third-party website does not imply that we endorse it or that we are affiliated with it. We do not control third-party websites, and we are not responsible for their content, security, or privacy practices. You access such third-party websites at your own risk, and you should always review the privacy policies of those websites before providing any Personal Data.
8.2 BeskarStaff as Data Controller
Protection of Personal Data is extremely important to us. Our Privacy Policy explains how and for what purposes we collect, use, retain, disclose, and safeguard Personal Data as Data Controller, including candidate profiles and recruitment data processed through our AI algorithms. You acknowledge that BeskarStaff is the Data Controller with respect to the processing of Personal Data for which BeskarStaff determines the purposes and essential means of processing as set out in BeskarStaff's Privacy Policy.
8. Children's Privacy
Our Sites and Services are intended for individuals who are at least 16 years old. We do not knowingly collect Personal Data from children under the age of 16. If we become aware that we have inadvertently collected Personal Data from a child under 16, we will take steps to delete such information promptly.
8.3 Your data privacy obligations
You agree to the terms of our Privacy Policy, which we may update from time to time. You affirm that you are now and will continue to be compliant with all applicable laws governing the privacy, protection, and your use of Data that you provide to us or access through your use of the Services, including Swiss Federal Data Protection Act and any applicable EU regulations.
9. Processing and Data Transfers
BeskarStaff GmbH stores and processes Personal Data primarily on servers located in Switzerland or the European Union. Any transfers of Personal Data to other countries will only occur in compliance with the Swiss Federal Act on Data Protection (revFADP), including Articles 16–18, and only where the destination ensures an adequate level of data protection or where appropriate safeguards such as Standard Contractual Clauses are in place. By using our Sites or Services, you acknowledge that your Personal Data may be transferred, stored, and processed outside of your region, subject to the legal protections described above.
10. Managing Your Information Preferences (Business Users)
If you are a Business User, you may review, update, or delete most of your Personal Data used for your account through your account settings. You may also contact us at privacy@beskarstaff.com to request changes or deletions, or to opt out of certain communications. Please note that while you can opt out of marketing emails, we may still send you administrative messages regarding your account or transactions with us.
9. Fees and taxes
BeskarStaff will provide the Services to you at the rates and for the fees ("Fees") described on the Pricing page and incorporated into this Agreement. We may revise the Fees at any time. However, we will provide you with at least 30 days' advance notice before revisions become applicable to you.
You are also obligated to pay all taxes, fees and other charges imposed by any governmental authority, including any value added tax, goods and services tax, sales tax and applicable indirect and transactional taxes ("Taxes") on the Services provided under this Agreement in accordance with Swiss tax regulations.
11. Candidate Data Privacy Rights
The BeskarStaff platform helps our business customers identify potential candidates for job opportunities. We respect your control over your personal data. Upon request, we will confirm whether we hold or process personal data about you. If we have collected your data, we will provide a copy. You may also request correction of inaccurate data, deletion of your data, or that we stop using it. In certain cases (e.g. if required by law, or if deletion is disproportionate in effort), we may not be able to fulfill the request in full but will provide an explanation.
To make a request, please email us at privacy@beskarstaff.com. We may require verification of your identity (e.g. your name and an email address we have on file). We will retain only the minimum data necessary to ensure continued compliance with your opt-out request, and we will not share this data with employers, recruiters, or other service users.
10. Term and termination
This Agreement is effective upon the date you first access or use the Services ("Effective Date") and continues until terminated by you or BeskarStaff. You may terminate this Agreement by closing your BeskarStaff Account at any time and ceasing to use the Services.
We may terminate this Agreement or close your BeskarStaff Account at any time for any reason by providing you with reasonable advance notice. We may suspend your BeskarStaff Account or terminate this Agreement, if: (i) we determine in our sole discretion that you are ineligible for the Services; (ii) you use the Services in a prohibited manner or otherwise do not comply with any of the provisions of this Agreement; (iii) any law requires us to do so.
12. Security and Data Retention
BeskarStaff GmbH implements physical, electronic, and procedural safeguards to protect personal data, including encryption in transit and at rest where appropriate. Our servers are located in Switzerland and/or the EU, operated by trusted providers such as Infomaniak, and designed to meet Swiss data protection standards.
No system can be guaranteed to be 100% secure. While we strive to protect your data, we cannot guarantee absolute security.
We retain your data only as long as necessary for the purposes set out in this Privacy Policy, including compliance with legal obligations, dispute resolution, or protection of legitimate interests that are not overridden by your rights.
11. Proprietary rights
Subject to the terms and conditions of this Agreement, including the payment of the applicable Fees, BeskarStaff hereby grants you, solely during the term of this Agreement, a non-exclusive, non-transferable, non-sublicensable right to access and use the Services, the Dashboard and the Documentation for your own commercial recruitment purposes.
Nothing in this Agreement affects BeskarStaff and its licensors rights, title, and interest in the IP, AI algorithms, or any copies thereof.
13. Privacy Policy Changes
We may update this Privacy Policy from time to time. If we make material changes, we will notify you through appropriate means (e.g., via email or an in-platform notice). Updates will take effect as of the "Revised" date indicated. Continued use of the Sites or Services means you accept the revised policy.
12. No warranties and limitation of liability
Except as expressly and specifically provided in this Agreement, the Services are provided to you "as is" and without warranty of any kind, whether express, implied, statutory, or otherwise.
Under no circumstances will either party be responsible or liable to you, whether in tort (including for negligence or breach of statutory duty), contract, misrepresentation, restitution or otherwise for any indirect, punitive, incidental, special, consequential, or exemplary damages.
13. Governing law and jurisdiction
This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the laws of Switzerland.
Each party irrevocably agrees that the courts of Switzerland shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement.
14. Vulnerability Disclosure Policy
At BeskarStaff GmbH, the security of our systems and the protection of our users' data are of utmost importance to us. We welcome responsible disclosure of potential vulnerabilities in our systems by security researchers and other external parties.
If you believe you have discovered a security vulnerability or other weakness in our systems, we encourage you to notify us by email at: security@beskarstaff.com
Please provide sufficient detail so that we can understand and verify the nature of the issue. Our goal is to acknowledge receipt of your report as promptly as possible, and we aim to confirm receipt within 5 business days where feasible. We will review all submissions diligently and take appropriate measures where necessary.
We ask that you:
- Refrain from exploiting or disclosing the vulnerability publicly or to third parties before we have addressed the issue.
- Avoid privacy violations, data destruction, or service disruption when conducting your research.
- Comply with applicable laws at all times.
We greatly appreciate contributions from the security community and are committed to constructive cooperation in addressing potential risks.
